Private payroll loan

Integrate your service with the BTG Pactual API to automate the onboarding of customers who requested a private payroll loan with your company

The payroll loan is a type of loan offered by financial institutions, with different variants such as the payroll loan for INSS beneficiaries, military personnel, public servants, and private-sector workers.
In this type of credit, the installments are deducted directly from the payroll or the benefit received. This structure significantly reduces the risk of default, which allows financial institutions to offer more attractive interest rates compared to other forms of credit.

🕰️ How it used to be

For the applicant to be eligible for a private payroll loan, the following criteria had to be met:

  1. The applicant had to have an active CLT (formal employment) contract with a company.
  2. The employer had to have an agreement with a financial institution authorized to operate this type of credit.

⚖️ What changed with Provisional Measure No. 1,292 of March 12, 2025

With the enactment of Provisional Measure No. 1,292/2025, there was a significant change:
the employer no longer needs to have an agreement with a financial institution for the worker to take out a private payroll loan. However, the requirement of a formal employment relationship (CLT) remains.

📲 How the contracting process works today

The loan request is made through the Carteira de Trabalho Digital (Digital Work Card) app, in the "Loans" tab.
In this section, the worker can simulate the desired amount, defining the number of installments they intend to pay. When a proposal is requested, the system makes the user's profile available to all financial institutions authorized to operate payroll loans. Each institution analyzes the risk profile and returns personalized offers, which may vary in interest rate, amount provided, and number of installments. The applicant then chooses the most advantageous offer and is directed to the channel of the chosen financial institution, where they finalize the loan contract.

💰 The payroll-deductible margin for the loan

There is a legal limit on the installment amount:

The loan installment cannot exceed 35% of the worker's net income, already accounting for the mandatory payroll deductions.

🛡️ Guarantees

  • In the event of the worker's termination, the following can be used:
    • up to 35% of the severance pay, or
    • up to 10% of the FGTS balance, or
    • 100% of the severance penalty (in the case of dismissal without cause)
as a guarantee of loan repayment. In the event of loss of the employment relationship, such as termination or resignation, the contract's payment method is changed from payroll deduction to direct debit or bank boleto, and the contract loses its payroll-deduction status.

🔍 Onboarding

The partner that integrates with BTG Empresas can automate the onboarding process of their payroll-loan customers. This step is essential to identify the customer, mitigate risks, and ensure compliance with the applicable legislation and the best practices of the financial market.
It is a process that provides greater security for the bank, the partner, and the customer, before the loan is disbursed.
